Terms for Members

The Gist
You are reading this because you bought, or are about to buy, access to a community that a Creator runs with Subscriby. The Creator is the seller. Subscriby is the software that carries your payment to the Creator's own account, opens the door to the community, keeps it open while you are paid up and closes it when you are not. These Terms say what Subscriby does for you, what it does not do, and what we ask of you. What you bought is governed by the Creator's own terms; the Creator's use of Subscriby is governed by our Terms of Service.
Terms for Members
These Terms for Members (hereinafter – "Terms") apply to every person who joins, buys access to, or takes part in a community that a Creator runs through Subscriby, whether the purchase was made on a Creator's portal, inside a connected platform, or with an access code. By joining such a community you accept these Terms, the Creator's own terms where the Creator publishes them, and the terms of the platform the community lives on.
We refer to Envigo Innovations, LLC (mailing address 2261 Market Street STE 86612, San Francisco, California, 94114, USA) as "Subscriby" or "we", to the person or business selling access as "Creator", to you as "Member" or "you", to the place where a community lives (a channel, a group, a server) as the "platform", and to the payment company a Creator connects (a card processor, a wallet, a regional or crypto processor, or a platform's native currency) as "Provider".
These Terms are an open and public document. The current effective version is located here. Where a Creator's own terms and these Terms cover the same point, the Creator's terms govern your purchase and these Terms govern your use of Subscriby.
Our Services are not directed to children. You may join a community run through Subscriby only if you are over the age of 16. If you are younger than this, do not buy access, and ask a parent or guardian to contact the Creator.
Who Does What
- The Creator
The Creator sets the price, describes what you get, delivers the content and the community, answers your questions, decides on refunds and publishes their own terms and privacy policy, which are linked from their portal. The Creator is responsible to you for what they sell, and they are the party you have a contract with when you buy.
- Subscriby
Subscriby provides the Creator with the software: the portal where you buy, the payment page that sends your money to the Creator's Provider, the invitation that opens the community to you, the renewals, the reminders before an expiry, the removal when access ends, and the billing history you can read in the portal. Subscriby provides no content, holds no money and makes no promise about the Creator's community. We do watch for abuse of the service, and we act on reports.
- The platform
The community lives on a platform that is not ours. Its terms bind you when you join, its rules decide what may be posted there, and it can remove anyone on its own grounds. Subscriby cannot restore access a platform has taken away.
- The Provider
Your payment is taken by the Creator's Provider under the Provider's own terms, and it goes to the Creator's account there. Card details you enter are handled by the Provider; Subscriby receives only a reference to the payment and its outcome.
Your Account
- Signing In
You use a Creator's portal with the identity you already have on the platform the community lives on, or with an email address. That identity is how the community recognises you, so keep it secure: anyone who controls it controls your memberships.
- One Person per Membership
A membership, a pass and an access code are for one person. Invite links, codes and sign-in details may not be shared, sold or passed on; a community that finds them shared may remove everyone who used them, and the Creator owes no refund for it.
- Accurate Details
The name, username and email you give must be yours and current. A payment made under someone else's identity, or with a payment method you are not allowed to use, may be reversed and the access ended.
- Leaving
You may leave a community at any time by cancelling your memberships in the portal and leaving the place on the platform. To have the data Subscriby holds about you deleted, write to the Creator or to support@subscriby.net, as the Privacy Policy describes.
Buying Access
- What You Buy
You buy access to a community for a period: a recurring membership that renews, a lifetime membership, a pass that opens for a fixed window, a series of such windows, or a trial. The plan you chose, its price, its currency and its length are shown on the portal before you pay and again in your billing history afterwards.
- Automatic Renewal
A recurring membership renews automatically at the end of each period, at the price the Creator has set for it at that time, until you cancel it in the portal. Subscriby sends you a reminder before a renewal and before an expiry. If a renewal payment fails, the Provider may retry it; access lasts to the end of the paid period and reopens when a payment succeeds.
- Trials
A trial gives you access for the trial period without a payment. Where the Creator set the trial to convert into a paid membership, the first payment is taken when the trial ends unless you cancel before then; where it does not convert, access simply ends.
- Native Platform Currency
Where you pay in a platform's own currency, the platform's purchase and refund rules apply in addition to these Terms, and Subscriby records what the platform reports.
- Access Codes
An access code is access the Creator grants without a payment through Subscriby, for the period the code carries. It is not a purchase from Subscriby, and it may be withdrawn by the Creator by cancelling the membership it opened.
- Taxes
The Creator is responsible for any tax on what they sell. Where a tax is due and the Creator collects it, it is included in the price you see or shown separately before you pay.
Cancelling, Refunds and Disputes
- Cancelling
You may cancel a recurring membership at any time in the portal. Cancelling stops the next renewal; your access lasts until the end of the period you have paid for, and no part of that period is refunded by the cancellation.
- Refunds
Refunds are the Creator's decision under the Creator's own refund terms, because the Creator is the seller and holds the money. Ask the Creator first, through the contact details on their portal or the support chat inside the project. A full refund ends your access at once; a partial refund leaves it in place. Subscriby cannot refund a payment it never received. Our Refund Policy explains this in full.
- Disputes
If you dispute a payment with your bank or card company, the dispute goes to the Creator's Provider and the Creator answers it. Ask the Creator before you dispute: a chargeback raised in place of a refund request ends your access, may cost the Creator a fee, and may lead the Creator to refuse you in future.
- Removal by the Creator
A Creator may cancel your membership or remove you from the community under their own rules. Whether any part of what you paid comes back is between you and the Creator; Subscriby records the change and closes the access.
Your Conduct
The community's own rules apply inside it. On top of them, you agree not to:
- Share, resell or publish invite links, access codes, sign-in details or the content you paid to see.
- Get around the access controls: rejoining after removal, using a second identity to keep access you no longer pay for, or exploiting a fault in the service.
- Harass, threaten or defraud the Creator or other Members, or impersonate either.
- Use a payment method that is not yours, or reverse a payment you knowingly made.
- Use the community for anything illegal where you are or where the Creator is.
The Creator and the platform may remove a Member who breaks these rules, and Subscriby may suspend a Member's access to every community run through it for abuse of the service, without a refund of anything already paid.
Your Data
- What Subscriby Holds
To run your memberships Subscriby processes the identity you sign in with (its identifier, your username and display name), the email you give, references to your payments and their outcome (never a full card number), the status and dates of each membership, and the messages you send to the Creator through the support chat. The Privacy Policy describes how this data is kept, secured and deleted.
- Shared with the Creator
The Creator sees who their Members are, what they bought and when it renews or ends, because they cannot run the community otherwise. For that data the Creator is the controller and Subscriby the processor; the Creator's own privacy policy on their portal says what they do with it. Subscriby does not sell your data and does not give it to other Creators.
- Your Rights
You can read your memberships and payments in the portal at any time. To access, correct or delete the rest, or to object to a use, write to the Creator for the data they control and to support@subscriby.net for the data Subscriby controls; we answer within the time the law you are under allows.
What We Cannot Promise
Subscriby does not check what a Creator claims, whether the content is what was described, whether it is delivered, whether the community is lawful where you are, or whether the Creator is who they say they are. Buy with the care you would use anywhere else online: read the Creator's terms, start with the shortest plan, and ask the Creator before you pay if something is unclear.
If a Creator's account with Subscriby is closed, by them or by us, the memberships run through it end and you are told. If a platform bans the Creator's bot, channel or account, the Creator may restore the community through Subscriby's recovery tools and re-admit you; if they do not, your remedy is with the Creator.
We keep the service available with reasonable care, but we do not promise that it is free of interruptions, and we may change or withdraw a feature. A payment that fails because of an interruption on our side is not lost: access reopens when it goes through.
Reporting a Creator
If a Creator took your money and delivered nothing, sold something they had no right to sell, runs a scam or a prohibited business, or breaks the rules on our Compliance page, write to support@subscriby.net with the portal link, what you bought and what happened. We investigate every report, we act on what we confirm, up to closing the Creator's account, and we keep the outcome confidential. We cannot refund you on the Creator's behalf, but a confirmed report weighs in your favour with your bank. Copyright complaints follow the DMCA process on the Compliance page.
Liability
To the extent the law allows, Subscriby is not liable to you for what a Creator sells, describes, delivers or fails to deliver, for what a platform or a Provider does, for content posted by a Creator or another Member, or for a loss that comes from your dealings with a Creator. Where liability cannot be excluded, it is limited to the amount you paid through Subscriby in the twelve months before the claim.
You release Subscriby from claims that arise from a transaction or a dispute between you and a Creator, except where the claim is caused by our breach of these Terms or by our own negligence. Nothing in these Terms takes away rights you have as a consumer under a law that cannot be contracted out of.
Changes
We may change these Terms as our Services change. If we make changes that are material, we will post the new version on the Subscriby website before it takes effect, and the Creators whose communities you belong to are told. Staying in a community after a change takes effect means you accept the changed Terms.
